§ 1 General Provisions
- This Terms and Conditions document defines the rules for making purchases in the online store PROFUNDUM, available at www.profundum.co, operated by PROFUNDUM Dominik Schneider, located at ul. Józefa Ignacego Kraszewskiego 14/5, 30-110 Kraków, NIP: 7352883976, REGON: 383391162. The Terms and Conditions also specify the rules for the delivery of goods purchased by the Customer.

- The Terms and Conditions are an integral part of the Sales Agreement concluded with the Customer.
The condition for placing an order in the online store is the Customer's acceptance of these Terms and Conditions. - The PROFUNDUM online store is operated by: PROFUNDUM Dominik Schneider, located at ul. Józefa Ignacego Kraszewskiego 14/5, 30-110 Kraków, NIP: 7352883976, REGON: 383391162.
- The Customer’s placement of an order via the website https://www.profundum.co is equivalent to acceptance of the rules set forth in these Terms and Conditions and obliges the Customer to comply with the rules specified herein.
§ 2 Definitions
- Seller – PROFUNDUM Dominik Schneider, located at ul. Józefa Ignacego Kraszewskiego 14/5, 30-110 Kraków, NIP: 7352883976, REGON: 383391162.
- Customer – a natural person, legal entity, or organizational unit without legal personality that places an order in the online store.
- Consumer – A Customer who is a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity, in accordance with Art. 22¹ of the Civil Code.
- Online Store/Store – the website available at www.profundum.co, through which the Customer can place orders.
- Goods – products offered by the Seller via the Online Store.
- Sales Agreement/Agreement – an agreement for the sale of Goods as defined by the Civil Code, concluded between the Seller and the Customer via the Online Store.
- Terms and Conditions – this document.
§ 3 Placing Orders
- The Store enables the purchase of Goods from the Seller, displayed on the Store’s website.
- To place an order, the Customer must select the Goods in the Store, add them to the "Cart" using the appropriate button, and proceed with the order placement process by selecting the relevant options (delivery and payment methods).
- Information about the Goods in the Store, including their characteristics and prices, constitutes an invitation to conclude a sales agreement under Art. 71 of the Civil Code Act of April 23, 1964 (Journal of Laws 2024, item 1061, as amended), in accordance with the conditions of these Terms and Conditions.
- The condition for placing an order in the Store is filling out all required data in the order form necessary to process the order, issue a sales confirmation, and arrange shipment.
- The Customer’s confirmation of the order by clicking the "Buy and Pay" button (or another button with equivalent wording) means:
a) Submitting an offer to purchase the Goods in accordance with the options selected in the order and these Terms and Conditions,
b) Acceptance of the obligation to pay the price of the Goods and the cost of their delivery. - The Sales Agreement is concluded when the Seller accepts the order for processing (acceptance of the Customer’s offer), which the Seller confirms via email with an order confirmation.
- If the order cannot be fulfilled (in whole or in part), the Seller will inform the Customer—no Agreement is concluded in such a case. The Seller will also inform the Customer of alternative fulfillment options, such as partial fulfillment or waiting for the Seller to restock. If the Customer has already paid for the order and fulfillment is impossible, the Seller will immediately refund the payment (according to the scope of the order cancellation).
- The Seller provides the Customer with confirmation of the Agreement on a durable medium no later than upon delivery of the Goods.
- For orders shipped to countries outside the European Union, the Customer should be aware that customs duties, taxes, and other import fees may be charged by the customs authorities of the destination country. These charges are the sole responsibility of the Customer and are not included in the price of the Goods or the delivery cost paid to the Seller. The Seller has no control over these charges and cannot predict their amount. The Customer is advised to contact their local customs office for more information before placing an order.
- The Store is not responsible for undelivered orders or delivery delays resulting from the Customer providing an incomplete/incorrect delivery address or failing to provide other data necessary for order fulfillment.
- The Seller reserves the right to suspend order fulfillment if the Customer provides false data or if the data raises justified doubts about its accuracy. In such a case, the Seller (if possible) will attempt to contact the Customer to verify the data.
§ 4 Payments
- The prices of Goods are given in Polish złoty (PLN) and in gross amounts, i.e., including VAT.
- The delivery cost is listed separately in the Store’s cart, depending on the delivery method chosen by the Customer.
- Online payments in the Store are processed by, among others, the following payment providers: Visa, Mastercard, AmEx, ApplePay, GPay, BLIK.
§ 5 Delivery
- Goods are delivered according to the Customer’s choice:
- Via courier company,
- Personal pickup.
- The Customer may also pick up the order in person at the address indicated by the Seller, after agreeing on a pickup date.
- Except for Goods picked up personally by the Customer, the order is considered fulfilled upon handing the shipment over to the Customer (entrusting the shipment to the carrier). The exact delivery date is determined by the carrier.
- Goods are dispatched by the Seller within 3 business days, unless a different deadline is explicitly stated in the product description when the Customer places the order.
- The Seller typically processes orders within the Republic of Poland, with delivery costs as indicated on the Store’s website under the "SHIPPING" section.
- Orders with delivery outside the Republic of Poland are possible after prior agreement with the Customer. Costs and availability of international shipping may vary depending on the destination country and chosen delivery method.
§ 6 Right to Withdraw from the Agreement
- Under Art. 27 of the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827), the Consumer has the right to withdraw from a distance contract without giving a reason within 14 days of receiving the Goods.
- To exercise the right of withdrawal, the Consumer must inform the Seller of their decision via an unambiguous statement sent to the email address info@profundum.co.
- The Consumer may use the withdrawal form template attached to the Consumer Rights Act, but this is not mandatory.
- In case of withdrawal, the Consumer must return the undamaged Goods (all packaging, wrappings, etc., must be intact especially the label on the packaging, which functions as a warranty sticker, must remain intact (unbroken)) immediately, no later than 14 days from the day they informed the Seller of the withdrawal.
- The Consumer bears the direct cost of returning the Goods.
- The Seller refunds all payments received, including delivery costs (except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest offered by the Seller), immediately, no later than 14 days from receiving the withdrawal declaration.
- In the event of the Consumer failing to collect the shipment (e.g., due to not picking it up from a collection point or undeliverability caused by the Consumer) and its return to the Seller, the Seller will refund the order value less the total shipping costs (including the cost of shipping to the Consumer and the cost of returning the shipment incurred by the Seller). The refund will be made within 14 days of the Seller receiving the returned shipment, to the bank account number provided by the Consumer.
§ 7 Complaints
- The Seller is obliged to provide the Customer with Goods that comply with the Agreement.
- For Consumers, the Seller is liable for the conformity of Goods under the Consumer Rights Act and the Civil Code.
- Complaints may be submitted:
- Electronically to: info@profundum.co
- In writing to: ul. Józefa Ignacego Kraszewskiego 14/5, 30-110 Kraków.
- The Seller will process the complaint in the form it was submitted (in writing or via email) within 14 days of receipt.
- If dissatisfied with the Seller’s handling of the complaint, the Consumer may (in addition to ordinary court proceedings) use out-of-court complaint and claim resolution methods.
- For this purpose, the Consumer may:
- Request mediation by the regional inspector of the Trade Inspection,
- Seek assistance from the county/municipal consumer ombudsman or a social organization tasked with consumer protection,
- Apply to a permanent consumer arbitration court for dispute resolution.

§ 8 Personal Data Protection
- The Seller is the administrator of the Customer’s personal data.
- Personal data is processed in accordance with applicable laws, including Regulation (EU) 2016/679 (GDPR).
- Personal data is processed for order fulfillment, complaint handling, and (if the Customer consents) marketing purposes.
- The Customer has the right to access, correct, delete, or object to the processing of their data.

§ 9 Final Provisions
- The Seller reserves the right to amend these Terms and Conditions. Changes may not violate the rights acquired by the Customer before the new Terms and Conditions take effect.
- Matters not regulated herein are governed by applicable law, particularly:
- The Civil Code (Journal of Laws 1964 No. 16, item 93, as amended),
- The Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827, as amended),
- The Personal Data Protection Act of May 10, 2018 (Journal of Laws 2018, item 1000),
- The GDPR (EU) 2016/679.
- Disputes arising from the Sales Agreement will be resolved by competent common courts.
- These Terms and Conditions are effective as of June 15, 2025.
